Terms of Service

These Terms of Service (“Terms”) govern your access to and use of chainNode, a network asset discovery, monitoring, and blockchain verification platform operated by Witty Inventions Digital, LLC (“Company”, “we”, “us”, or “our”). By accessing or using chainNode, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, installing the chainNode agent, or accessing any part of the chainNode platform, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you may not use chainNode.

2. Authorized Use of the Discovery Agent

The chainNode agent performs active network scanning and asset discovery using industry-standard techniques including port scanning, protocol probing, and device fingerprinting. This functionality is powerful and must be used responsibly and lawfully.

Prohibited — Unauthorized Network Scanning

You may only deploy and operate the chainNode agent on networks that you own or for which you have received explicit, documented authorization from the network owner or administrator.

Scanning, probing, or monitoring any network, device, or system without prior written authorization from its owner is strictly prohibited under these Terms and may constitute a violation of applicable law, including but not limited to the Computer Fraud and Abuse Act (CFAA, 18 U.S.C. § 1030), the Electronic Communications Privacy Act (ECPA), and equivalent laws in other jurisdictions.

Examples of prohibited use include but are not limited to: scanning public WiFi networks, coffee shop or hotel networks, co-working space networks, or any network infrastructure not under your direct administrative control — regardless of whether you are connected to that network.

By using chainNode, you represent and warrant that:

You are the owner of, or have explicit written authorization to scan and monitor, every network on which you deploy the chainNode agent.
You will not use chainNode to scan, probe, or discover devices on any network without such authorization.
You will maintain documentation of your authorization to scan any network on which chainNode is deployed and will provide such documentation to the Company upon request.
You will configure the chainNode agent to scan only the IP ranges and subnets you are authorized to access.

3. Accounts and Access

You must provide accurate and complete information when creating a chainNode account. You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately at support@chainnode.pro if you suspect unauthorized access to your account.

You may not share your account, API keys, or agent credentials with third parties outside your organization without prior written consent from the Company.

4. Blockchain Transactions

chainNode records asset discovery events and configuration changes to the Polygon blockchain. These records are permanent and immutable by design. Once a transaction is submitted to the blockchain, it cannot be deleted, altered, or reversed by the Company or by you. You acknowledge and accept this characteristic of blockchain technology.

Blockchain transaction fees (gas fees) are included in your subscription and paid by the Company on your behalf via a relay wallet. The Company reserves the right to adjust fee structures with 30 days notice.

5. Subscription and Payment

chainNode is offered on a subscription basis. Billing is processed through Stripe. You authorize the Company to charge your payment method on a recurring basis at the subscription rate in effect at the time of renewal. Subscriptions renew automatically unless cancelled before the renewal date.

The Company reserves the right to modify pricing with 30 days advance notice. Continued use of the service after a price change constitutes acceptance of the new pricing.

6. Prohibited Conduct

In addition to the network scanning prohibition in Section 2, you agree not to:

Use chainNode to monitor individuals without their knowledge or consent in violation of applicable privacy laws.
Attempt to reverse engineer, decompile, or extract the source code of the chainNode platform or agent.
Use chainNode in connection with any illegal activity or in violation of any applicable law or regulation.
Resell, sublicense, or redistribute chainNode without written authorization from the Company.
Interfere with or disrupt the integrity or performance of the chainNode platform or its underlying infrastructure.
Use chainNode to store, transmit, or record personal health information (PHI) or payment card data (PCI) without prior written agreement with the Company.

7. Data and Privacy

The chainNode agent collects network asset metadata including IP addresses, MAC addresses, hostnames, open ports, firmware versions, and configuration states. This data is processed and stored to provide the chainNode service. Our collection and use of this data is described in our Privacy Policy.

You retain ownership of all data collected from your network. The Company does not sell your network data to third parties.

8. Intellectual Property

chainNode, its logo, and all related software, documentation, and materials are the property of Witty Inventions Digital, LLC and are protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in chainNode.

9. Disclaimer of Warranties

chainNode is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Company does not warrant that chainNode will be uninterrupted, error-free, or that all network assets will be discovered or accurately classified.

10. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of chainNode, including but not limited to damages arising from missed asset discoveries, inaccurate classifications, or blockchain transaction failures. The Company’s total liability shall not exceed the amount you paid for chainNode in the three months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Witty Inventions Digital, LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of chainNode in violation of these Terms; (b) your unauthorized scanning of networks; (c) your violation of any applicable law or third-party right; or (d) any data collected from your network.

12. Termination

The Company reserves the right to suspend or terminate your account immediately and without notice if you violate these Terms, particularly Section 2 (Authorized Use of the Discovery Agent) or Section 6 (Prohibited Conduct). Upon termination, your right to use chainNode ceases immediately. Blockchain records already written to the Polygon network will remain as they are immutable by design.

13. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Wake County, North Carolina.

14. Changes to These Terms

The Company may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the chainNode dashboard. Continued use of chainNode after changes take effect constitutes acceptance of the revised Terms.
